تنظّم هذه الشروط والأحكام استخدامك لموقع www.knowledgestreams.co وشراءك للباقات الاستشارية المقدّمة تحت علامة «Knowledge Streams»، التي تديرها منشأة KNOWLEDGE STREAMS FOR CONSULTANCY AND BUSINESS DEVELOPMENT المرخّصة في إمارة أبوظبي، دولة الإمارات العربية المتحدة («نحن»).
باستخدامك الموقع أو تقديمك طلب شراء، فإنك توافق على هذه الشروط. إذا كنت تشتري نيابةً عن شركة، فأنت تؤكد أنك مخوّل بإلزامها بهذه الشروط، ويُقصد بـ«العميل» حينها الشركة.
02تعريفات
الباقة: الباقة الاستشارية التي تشتريها (الأساسية أو الاحترافية أو المؤسسية أو باقة مخصصة)، وتتكون من الخدمات الاستشارية والوثائق الموصوفة لها على الموقع أو في عرض السعر.
الوثائق: الوثائق الرقمية (أدلة، سياسات، إجراءات، نماذج، سجلات، مواد تدريبية) الخاصة بنظام إداري أو أكثر، والمُسلَّمة ضمن الباقة.
الخدمات: الخدمات الاستشارية في الباقة، مثل جلسة الانطلاق، ومراجعات التوافق، وورش العمل، والتدقيق التجريبي، والدعم، بحسب الباقة المختارة.
العميل: الشخص أو المنشأة التي تشتري الباقة.
03طبيعة ما نقدّمه
نقدّم باقات استشارية تجمع بين خدمات استشارية ووثائق جاهزة للتخصيص، لمساعدتك على بناء نظامك الإداري وتطبيقه. لسنا جهة منح شهادات أو جهة اعتماد، ولا تتضمن أي باقة شهادة ISO؛ إذ تصدر الشهادة عن جهة منح شهادات مستقلة بعد تدقيقها الخارجي.
الوثائق نماذج يجب تكييفها مع عمليات منشأتك وسجلاتها الفعلية. نجاح التدقيق يعتمد على تطبيقك الفعلي للنظام، لذلك لا نضمن الحصول على الشهادة أو نتيجة تدقيق معيّنة.
04الطلبات والأسعار والدفع
يُعدّ الطلب مقبولًا عند تأكيدنا له كتابيًا (بالبريد الإلكتروني أو الفاتورة) واستلام الدفعة المستحقة.
تُعرض الأسعار بالدولار الأمريكي، والأسعار بالدرهم الإماراتي تقريبية بسعر الصرف الثابت. يُعتمد السعر المذكور في الفاتورة أو عرض السعر.
الأسعار المعروضة على الموقع نهائية. لسنا مسجّلين حاليًا في ضريبة القيمة المضافة، لذلك لا تُضاف الضريبة إلى المبلغ. وإذا سُجّلنا مستقبلًا فسنضيف الضريبة بالنسبة المقررة وفق المرسوم بقانون اتحادي رقم (8) لسنة 2017 بشأن ضريبة القيمة المضافة، ونوضحها على الفاتورة قبل الدفع.
يتم الدفع كاملًا عند الطلب عبر بوابة الدفع الآمنة (Stripe).
05التسليم
نسلّم وثائق الباقة رقميًا (رابط تنزيل أو بريد إلكتروني) خلال 24 ساعة من تأكيد الدفع في أيام العمل الرسمية في الدولة. تُجدول الخدمات المباشرة، مثل الجلسات وورش العمل، بالاتفاق معك خلال مدة الباقة.
06الترخيص وحقوق الملكية الفكرية
جميع الوثائق والمواد محمية بموجب المرسوم بقانون اتحادي رقم (38) لسنة 2021 بشأن حقوق المؤلف والحقوق المجاورة، وتبقى ملكيتها لنا. عند سداد الثمن نمنحك ترخيصًا دائمًا وغير حصري وغير قابل للتحويل لاستخدامها داخليًا في منشأتك، ويشمل ذلك:
تعديل الوثائق وإضافة شعارك واسم منشأتك إليها.
استخدامها من قِبل موظفيك ومستشاريك لأغراض منشأتك فقط، ودون حد لعدد المستخدمين.
ولا يحق لك، دون موافقتنا الكتابية:
بيع الوثائق أو إعادة توزيعها أو نشرها أو مشاركتها مع منشآت أخرى، بما فيها الشركات الشقيقة.
استخدامها لتقديم خدمات استشارية أو تدريبية لأطراف أخرى.
تحميلها على مواقع أو منصات عامة.
07التحديثات والدعم
نقدّم التحديثات والدعم للمدة المذكورة في كل باقة، عبر البريد الإلكتروني وواتساب، باللغتين العربية والإنجليزية، خلال أيام العمل الرسمية في الدولة. الدعم إرشادي ولا يحلّ محل تطبيقك الفعلي للنظام.
08ضمان الجودة وسياسة الاسترداد
لأن وثائق الباقة رقمية تُخصّص باسم شركتك ويمكن الاحتفاظ بنسخ منها بعد تنزيلها، نطبّق السياسة التالية، ونعرضها قبل الدفع:
قبل التسليم: يمكنك إلغاء الطلب واسترداد كامل المبلغ في أي وقت قبل أن نرسل لك ملفات الباقة، دون الحاجة إلى ذكر سبب.
ضمان الجودة خلال 14 يومًا من التسليم: إذا كانت أي وثيقة ناقصة أو تالفة أو لا تطابق الوصف المنشور، أو سلّمناك نظامًا غير الذي طلبته، راسلنا على customer.services@knowledgestreams.co مع توضيح المشكلة، وسنصلحها أو نستبدل الملفات خلال 5 أيام عمل. وإن تعذّر علينا ذلك، نعيد لك ثمن الباقة كاملًا.
تغيير الرأي بعد التسليم: لا يُسترد المبلغ بعد تسليم الملفات لمجرد تغيير الرأي أو عدم الحاجة إليها.
الخدمات المباشرة (مثل مراجعة التوافق وورشة التخصيص والتدقيق التجريبي والتدريب): لا تُسترد بعد تقديمها، ويُرد الجزء المقابل للخدمات التي لم تُقدَّم بعد بنسبتها من سعر الباقة.
تُعاد المبالغ المعتمدة إلى وسيلة الدفع الأصلية خلال 14 يومًا من الموافقة. وبعد الاسترداد ينتهي الترخيص وتلتزم بحذف جميع نسخ الوثائق وعدم استخدامها. ويُمنح الاسترداد مرة واحدة لكل منشأة.
لا تُخلّ هذه السياسة بأي حقوق مقررة لك بموجب القانون الاتحادي رقم (15) لسنة 2020 بشأن حماية المستهلك ولائحته التنفيذية، ومنها حقك في الإصلاح أو الاستبدال أو الاسترداد إذا كانت الخدمة معيبة أو غير مطابقة للمواصفات المعلنة.
09المعاينة المجانية
نقدّم المعاينة المجانية لأغراض التقييم فقط، وتخضع لنفس قيود الترخيص أعلاه، ولا يجوز استخدامها تجاريًا أو إعادة توزيعها.
10التزامات العميل
تقديم معلومات صحيحة عند الطلب والفوترة.
مراجعة الوثائق وتكييفها مع عملياتك والمتطلبات القانونية والتنظيمية التي تنطبق على نشاطك.
الحفاظ على سرية روابط التنزيل وعدم مشاركتها خارج منشأتك.
11حدود المسؤولية
نقدّم الوثائق والخدمات بعناية مهنية، لكنها لا تُعد استشارة قانونية. وفي الحدود التي يسمح بها القانون:
لا نتحمّل المسؤولية عن الأضرار غير المباشرة، أو فوات الربح، أو نتائج التدقيق الخارجي.
لا تتجاوز مسؤوليتنا الإجمالية عن أي مطالبة المبلغ الذي دفعته لنا مقابل الباقة محل المطالبة.
لا يحدّ أي شيء في هذه الشروط من مسؤوليتنا في الحالات التي لا يجيز القانون تحديدها، مثل الغش أو الخطأ الجسيم.
12السرية
نتعامل مع المعلومات التي تشاركها معنا عن منشأتك بسرية، ولا نستخدمها إلا لتقديم الخدمة. لا نذكر اسم منشأتك عميلًا لنا أو ننشر رأيك دون موافقتك الكتابية.
13استخدام الموقع
يجب استخدام الموقع بشكل قانوني، ويُمنع أي استخدام يضرّ به أو بأمنه أو يجمع بياناته آليًا. محتوى الموقع وتصميمه وعلامته التجارية مملوكة لنا. ويُقصد بأي إحصاءات أو أوصاف تسويقية على الموقع التعريف العام بخدماتنا، ويُعتمد ما يرد في عرض السعر أو الفاتورة.
14المراسلات الإلكترونية
توافق على أن الطلبات والموافقات والفواتير والمراسلات الإلكترونية بيننا تُعد صحيحة ومنتجة لآثارها القانونية، وفقًا للمرسوم بقانون اتحادي رقم (46) لسنة 2021 بشأن المعاملات الإلكترونية وخدمات الثقة.
15القانون الواجب التطبيق وحل النزاعات
تخضع هذه الشروط للقوانين الاتحادية لدولة الإمارات العربية المتحدة وقوانين إمارة أبوظبي. نسعى أولًا إلى حل أي خلاف وديًا خلال 30 يومًا من إخطارنا به كتابيًا، فإن تعذّر ذلك تختص محاكم إمارة أبوظبي بنظره.
16اللغة
تتوفر هذه الشروط باللغتين العربية والإنجليزية. وفي حال وجود تعارض بين النسختين، يُعتمد النص العربي.
17تعديل الشروط
قد نعدّل هذه الشروط من وقت لآخر، وتسري النسخة المنشورة وقت تقديم طلبك على ذلك الطلب.
These terms govern your use of www.knowledgestreams.co and your purchase of the consulting packages offered under the “Knowledge Streams” brand, operated by KNOWLEDGE STREAMS FOR CONSULTANCY AND BUSINESS DEVELOPMENT, licensed in the Emirate of Abu Dhabi, United Arab Emirates (“we”, “us”).
By using the site or placing an order, you accept these terms. If you buy on behalf of a company, you confirm you are authorised to bind it, and “Customer” then means that company.
02Definitions
Package: the consulting package you buy (Essential, Professional, Enterprise or a custom package), made up of the Services and the Documents described for it on the site or in your quote.
Documents: the digital documents (manuals, policies, procedures, forms, records and training material) for one or more management systems, delivered as part of the Package.
Services: the consulting services in the Package, such as the kick-off session, compliance reviews, workshops, mock audits and support, depending on the Package.
Customer: the person or organisation buying the Package.
03What we provide
We provide consulting packages that combine consulting services with ready-to-customise documentation, to help you build and implement your management system. We are not a certification or accreditation body, and no package includes an ISO certificate; certificates are issued by an independent certification body after its external audit.
The documents are templates that must be adapted to your organisation’s real processes and records. Audit success depends on how you implement the system, so we do not guarantee certification or any particular audit result.
04Orders, prices and payment
An order is accepted once we confirm it in writing (by email or invoice) and receive the payment due.
Prices are set in US dollars; AED prices are approximate, at the fixed exchange rate. The price on your invoice or quote applies.
Prices shown on the site are final. We are not currently registered for VAT, so no VAT is added. If we register in the future, VAT will be added at the applicable rate under Federal Decree-Law No. 8 of 2017 on Value Added Tax and shown on the invoice before you pay.
Payment is taken in full when you order, through our secure payment provider (Stripe).
05Delivery
We deliver the Documents digitally (download link or email) within 24 hours of payment confirmation, on UAE business days. Live services such as sessions and workshops are scheduled with you during the package period.
06Licence and intellectual property
All documents and materials are protected under Federal Decree-Law No. 38 of 2021 on Copyright and Neighbouring Rights and remain our property. Once paid for, we grant you a perpetual, non-exclusive, non-transferable licence to use them internally in your organisation, including to:
edit the documents and add your logo and company name;
let your employees and advisers use them for your organisation’s purposes only, with no limit on the number of users.
Without our written consent, you may not:
sell, redistribute, publish or share the documents with other organisations, including affiliated companies;
use them to provide consultancy or training to third parties;
upload them to public websites or platforms.
07Updates and support
Updates and support are provided for the period stated in each package, by email and WhatsApp, in Arabic and English, on UAE business days. Support is guidance and does not replace your own implementation of the system.
08Quality guarantee and refund policy
Because the Documents are digital files branded for your company, and copies can be kept once downloaded, the following policy applies. It is shown to you before you pay.
Before delivery: you can cancel your order for a full refund at any time before we send you the Document files, without giving a reason.
14-day quality guarantee after delivery: if any document is missing, faulty or not as described, or we delivered a different standard from the one you ordered, email customer.services@knowledgestreams.co describing the problem and we will fix or replace the files within 5 business days. If we cannot, we will refund the Package price in full.
Change of mind after delivery: payments are not refundable after the files are delivered because you have changed your mind or no longer need them.
Live services (such as compliance reviews, customisation workshops, mock audits and training): not refundable once delivered. The share of the package price for services not yet delivered is refunded pro rata.
Approved refunds are paid to your original payment method within 14 days of approval. After a refund your licence ends and you must delete all copies of the documents and stop using them. Refunds are limited to one per organisation.
This policy does not affect your statutory rights under Federal Law No. 15 of 2020 on Consumer Protection and its Executive Regulations, including your right to repair, replacement or refund if a service is defective or does not match its published description.

10Customer responsibilities
Give accurate information when ordering and for invoicing.
Review and adapt the documents to your operations and to the legal and regulatory requirements that apply to your business.
Keep download links confidential and do not share them outside your organisation.
11Limitation of liability
We prepare our documents and services with professional care, but they are not legal advice. To the extent the law allows:
we are not liable for indirect loss, loss of profit, or the outcome of an external audit;
our total liability for any claim is limited to the amount you paid us for the Package concerned.
Nothing in these terms limits our liability where the law does not allow it to be limited, such as for fraud or gross negligence.
12Confidentiality
We treat information you share about your organisation as confidential and use it only to provide our services. We will not name you as a client or publish your feedback without your written consent.
13Use of the website
You must use the site lawfully and must not harm it, compromise its security or scrape it automatically. The site’s content, design and brand belong to us. Statistics and marketing descriptions on the site give a general picture of our services; your quote or invoice is what applies to your order.
14Electronic communications
You agree that orders, approvals, invoices and other electronic communications between us are valid and legally effective under Federal Decree-Law No. 46 of 2021 on Electronic Transactions and Trust Services.
15Governing law and disputes
These terms are governed by the federal laws of the United Arab Emirates and the laws of the Emirate of Abu Dhabi. We will first try to resolve any dispute amicably within 30 days of written notice; failing that, the courts of the Emirate of Abu Dhabi have jurisdiction.
16Language
These terms are available in Arabic and English. If the two versions conflict, the Arabic text prevails.
17Changes to these terms
We may update these terms from time to time. The version published when you place an order applies to that order.
